In an effort to reduce burden, the Department of Health and Human Services (HHS) and CMS are seeking to update regulations around nondiscrimination outlined in the Affordable Care Act (ACA).
 
The proposed rule was published in the Federal Register June 14. It would make “substantial revisions” to Section 1557 of the ACA by eliminating “provisions that are inconsistent or redundant with pre-existing civil rights statutes and regulations prohibiting discrimination on the basis of race, color, national origin, sex, age, and disability.”
 
Under the proposed rule, HHS would continue enforcement of civil rights laws prohibiting discrimination on the basis of race, color, national origin, sex, age or disability
 
Public comment on the proposed rule is due by Aug. 13.
