The Department of Labor (DOL) announced Friday it will delay its enforcement of a recent federal court ruling to extend Fair Labor Standards Act (FLSA) protections, including paying overtime, to some 2 million home care workers.
 
The DOL will not enforce violations of the companionship exemption ruling until 30 days after the U.S. Court of Appeals for the District of Columbia issues a mandate making its opinion effective. On Aug. 21, the Court of Appeals ruled against the National Association for Home Care & Hospice (NAHC) and two other associations and said the DOL had the right to require overtime payments.
 
Two new motions were filed in early September in the battle over whether private duty agencies should continue to follow the companionship exemption that’s been in place for about 40 years (HHL 09/15).
