U.S. Supreme Court Chief Justice John Roberts has denied an application for stay on the Court of Appeals' ruling involving the companionship exemption. As a result, the new rules are still slated to go into effect Oct. 13, according to the National Association for Home Care & Hospice (NAHC).
 
"NAHC and its co-plaintiffs are evaluating further litigation options in the case," NAHC said on its website Oct. 6. "At this point, the remaining option is to ask the Supreme Court to hear the case on the merits while the new rules are in effect. It takes four justices to agree to hear the case out of the full Court of nine justices and a majority of five to overturn the appellate court’s ruling."
