A federal judge on Tuesday granted a nationwide preliminary injunction against the Labor Department’s new overtime rule — meaning the requirement is highly unlikely to take effect as scheduled Dec. 1. For many private duty agencies, the injunction is significant because the rule would have more than doubled the salary threshold for a worker to be entitled to overtime.

Cotiviti Healthcare, which previously served as a recovery audit contractor (RAC) for multiple types of health care providers including home health agencies, recently submitted about 71,000 home health claims adjustments to Medicare Administrative Contractor (MAC) Palmetto GBA for recovery.

Reps. James McGovern (D-Mass.) and Tom Price (R-Ga.) introduced a bill Sept. 28 that would impose a one-year moratorium on the pre-claim review demonstration that currently is roiling the home health industry in  Illinois. The bill would require CMS to report to Congress on the impact of the demo on patients, agencies, physicians and Medicare spending.

CMS announced Sept. 23 that it has postponed the home health, hospice and durable medical equipment open door forum it had previously scheduled for Oct. 5.

Agencies waiting with dread for pre-claim reviews to begin in their states can breathe a slight sigh of relief — CMS announced Sept. 19 that the demonstration is on hold outside of Illinois.

As part of a July 26 update to its Q&As on the pre-claim review demonstration, CMS has made clear what agencies should do if they receive a provisionally affirmed decision but find later in the episode that the patient needs new services, such as therapy.
